General Terms of Business and Use of TeckComm GmbH operating under the brand HORISIM.

By accessing or using the digital services of TeckComm GmbH, Teplitzer Str. 32, 14193 Berlin, Germany (hereinafter referred to as the “Provider” or “HORISIM”), in particular via the website www.horisim.com or via mobile applications and platforms of distribution partners, the user declares that they have read and accepted the Privacy Policy and these General Terms and Conditions (T&C).

By using the services, regardless of whether the purchase is made directly via the HORISIM shop or through an authorized distribution partner, a legally binding contract is concluded between the user and TeckComm GmbH.

The user expressly warrants that they are legally authorized and fully capable, within the meaning of applicable law, to enter into such a contract.

1. Scope of Application
1.1 These General Terms and Conditions apply to all contracts between TeckComm GmbH, Teplitzer Str. 32, 14193 Berlin, Germany (hereinafter referred to as the “Provider” or “HORISIM”), operating under the HORISIM brand, and the customer concerning the purchase and use of digital eSIM data packages concluded via the online platform or the mobile application of an authorized distribution partner.

1.2 The specific service features and country-specific usage information result from the product information sheet of the booked data package. This is provided to the customer prior to purchase by the provider or the distribution partner and forms an integral part of the contract.

1.3 Deviating terms and conditions of the customer shall only apply if expressly agreed to in writing.

2. Subject Matter of the Contract and Services
2.1 TeckComm GmbH, operating under the HORISIM brand, offers customers digital prepaid eSIM data packages for the use of mobile data services on eSIM-compatible devices. The services are provided both via the company’s own online shop at www.horisim.com and via authorized distribution partners.

2.2 Depending on the distribution channel, ordering, payment, and provision of the eSIM are carried out either via the HORISIM website or via the infrastructure of an authorized distribution partner. Payment processing is handled via common payment service providers, in particular Shopify and PayPal, or through a technical integration with the respective distribution partner.

2.3 After conclusion of the contract, the eSIM is provided to the customer electronically without delay, e.g., by email or via the web application and app of the respective distribution partner. The information required for installation and activation is included or provided electronically.

2.4 Acceptance of these General Terms and Conditions is required to use the services. As part of the purchase and registration process, the customer provides certain personal data, in particular first name, last name, email address, and billing address.

2.5 The customer is responsible for independently checking, prior to placing an order, whether their device is eSIM-compatible and not network-locked. A non-binding compatibility overview is available at phone-compatibility. Responsibility for the accuracy of this information lies with the customer.

2.6 The provider undertakes to deliver the contractually agreed services with customary market care and technical accuracy. No guarantee is given for uninterrupted, error-free, or continuous availability.

2.7 The customer undertakes not to use the services unlawfully, abusively, or fraudulently. In the event of violations, the provider reserves the right to temporarily or permanently block access to the service. The obligation to pay remains unaffected.

3. Contract Commencement, Activation, and Validity
3.1 The contract between the customer and TeckComm GmbH, operating under the HORISIM brand, is concluded upon completion of the order process via the online shop or an authorized distribution partner.

3.2 Activation of an eSIM purchased via www.horisim.com must take place within 60 calendar days from the purchase date. If activation does not occur within this period, the eSIM expires without replacement. No refund entitlement exists thereafter.

3.3 The usage period of the booked data package begins with the first connection of the eSIM to a foreign mobile network (roaming) and lasts, depending on the selected package 7, 15, or 30 calendar days.

3.4 The contract ends automatically upon deletion of the eSIM from the smartphone, expiration of the booked data package period, and/or expiration of the eSIM in accordance with Sections 3.2 or 3.3. No separate termination by the customer is required.

4. Prices and Payment Terms
4.1 Depending on the distribution channel, ordering, payment, and provision of the eSIM are carried out either via the HORISIM online shop at www.horisim.com or via the infrastructure of an authorized distribution partner.

4.2 Payment processing is carried out via external payment service providers, in particular Shopify, PayPal, Apple Pay, or Google Pay. When using an authorized distribution partner, processing may take place directly via their platform.

4.3 All payments are made in euros (€) or US dollars ($), unless expressly stated otherwise.

4.4 All stated prices are gross prices including statutory value-added tax, unless expressly stated as net prices.

4.5 The customer is only entitled to offset claims against claims of TeckComm GmbH if such counterclaims are undisputed or have been legally established.

5. Obligations of the Customer
5.1 Prior to concluding the contract, the customer is responsible for checking whether their device is technically suitable for using an eSIM, in particular whether it is eSIM-compatible, unlocked (network-independent), and suitable for international mobile connections. A non-binding overview of supported devices is available at phone-compatibility. The provider does not guarantee functionality on devices not listed or not properly unlocked.

5.2 The customer undertakes to use the provided eSIM data packages exclusively within the scope of the contractually agreed purpose, in particular only for approved mobile data usage.

5.3 Abusive, unlawful, or improper use, including but not limited to commercial resale, manipulation of network configurations, falsification of location (e.g. via VPNs to circumvent geographic restrictions), automated data retrieval, or any other non-contractual use, entitles the provider to immediately block or delete the eSIM profile without prior notice.

5.4 Any entitlement to a refund in the event of suspension due to a violation under Section 5.3 is excluded.

5.5 The customer is obliged to keep access data, QR codes, and installation information secure and not make them accessible to third parties. Transfer or duplication of the eSIM for use by third parties is expressly prohibited.

5.6 The customer further undertakes to comply with all applicable national and international laws when using the eSIM, in particular those of the respective country of stay.

6. Refund / Cancellation / Change Policy
If the customer is a consumer within the meaning of Section 13 of the German Civil Code (BGB), they are entitled to a right of withdrawal in accordance with statutory provisions. Details regarding the right of withdrawal, refund conditions, and the premature expiry of the right of withdrawal for digital content are set out in the separate cancellation policy and refund policy, which form part of these T&C.

6.1 Right of Withdrawal and Refund Conditions
6.1.1 Consumers within the meaning of Section 13 BGB generally have a right of withdrawal of fourteen (14) days from the date of purchase, provided the eSIM has not been activated or used. Use is deemed to have occurred in particular if the eSIM has been installed on a device and connected to a mobile network.

6.1.2 A decision on the refund will be made within ten (10) business days after receipt of a valid request. The refund will be made within a reasonable period, but no later than thirty (30) calendar days, depending on the payment service provider and the customer’s bank.

6.2 Submission of Requests
6.2.1 Refund requests must be submitted in writing to refund@horisim.com. The customer is obliged to provide all information required for review, in particular proof of purchase, identification of the used eSIM (ICCID or order number), a description of the issue, and, where applicable, technical evidence such as screenshots, settings, or error reports.

6.2.2 Compliance with the 14-calendar-day refund period from the purchase date is a prerequisite for processing the request. Refunds after expiry of this period are excluded.

6.3 Exclusions and Special Cases
6.3.1 A refund is excluded if other devices, SIM cards, providers, or telecommunications services not provided by HORISIM are used. Accidental purchases are also excluded once the eSIM has been activated, as it is then deemed used. Costs not directly related to the HORISIM service (e.g. hotel telephones or roaming charges due to incorrect settings) are likewise non-refundable. Deleted or removed eSIMs after activation are also non-refundable, particularly if this occurred without prior contact with support.

6.3.2 HORISIM reserves the right to refuse refunds at any time in the event of proven misuse, violation of these T&C, or fraudulent use. In the event of suspected fraud or misuse, the relevant customer account may be suspended.

6.3.3 In the case of unauthorized or non-authorized purchases, a refund will only be granted after individual review and approval by the provider.

6.4 Incorrect Invoice Amounts
If the customer, acting in good faith, disputes an invoice amount, the objection must be submitted in writing within fourteen (14) days of receipt of the invoice. The customer must specify which amounts are considered incorrect, why the calculation is inaccurate, and which amount is considered correct.

6.5 Refunds under Network Outage Guarantee
Refunds are granted exclusively in cases of demonstrable technical unavailability of the service, provided that no mobile data connection can be established despite proper installation and the user’s active cooperation within the support process. Any general right of withdrawal or cancellation beyond statutory provisions is excluded.

6.6 Goodwill Policy
6.6.1 Refund requests not covered by the above provisions will be reviewed on a case-by-case basis. Approval is granted solely on a goodwill basis. In exceptional cases where a refund is granted outside the regular refund conditions, a processing fee of up to five (5) EUR may be charged, depending on the actual review and administrative effort.

6.6.2 In no case may the maximum refund amount exceed the total amount originally paid.

7. Liability and Disclaimer
7.1 HORISIM is liable within the scope of statutory provisions exclusively for damages caused by intentional or grossly negligent breaches of duty. In the case of slightly negligent breaches of essential contractual obligations (cardinal obligations), liability is limited to the typical, foreseeable damage. Any further liability, in particular for indirect damages, consequential damages, or loss of profit, is excluded.

7.2 HORISIM does not guarantee uninterrupted, error-free, or continuous availability of the offered services or network connections. In particular, the quality and availability of mobile internet access provided by third parties (e.g. local network operators abroad) cannot be guaranteed.

7.3 The customer is responsible for the proper installation, activation, and configuration of the eSIM on their device. HORISIM shall not be liable for damages or malfunctions resulting from incorrect or incomplete installation of the eSIM, improper configuration or settings, use of a non-eSIM-compatible or locked device, or failure to follow instructions provided by HORISIM.

7.4 HORISIM shall not be liable for roaming charges or other costs incurred due to incorrect installation or deactivation of the eSIM profile, continued active mobile data connections (e.g. via another SIM card), improper configuration of the customer’s mobile plan, or parallel connections via a physical SIM.

7.5 HORISIM assumes no liability for damages or losses resulting from the loss, theft, or misuse of the device or the eSIM by unauthorized third parties.

7.6 By purchasing and using an eSIM product from HORISIM, the customer declares that they have taken note of these liability provisions. Any further claims for damages are excluded to the extent permitted by law.

7.7 In the event of technical uncertainties or problems, the customer is expressly advised to contact customer support at support@horisim.com before undertaking independent configuration.

8. Final Provisions
8.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Statutory provisions restricting the choice of law for consumers abroad remain unaffected.

8.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the registered office of TeckComm GmbH, currently 14193 Berlin, Germany.

8.3 Amendments and supplements to these General Terms and Conditions must be made in writing. This also applies to the waiver of the written form requirement itself, unless a stricter statutory form is prescribed.

8.4 Should any provision of these General Terms and Conditions be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the intended economic purpose.

8.5 TeckComm GmbH is not obliged to participate in dispute resolution proceedings before a consumer arbitration board and does not participate in such proceedings.
